This Beta Testing Agreement ("Agreement") is between you ("Tester") and Noted Labs (ABN 98 693 357 425) ("we", "us"). It applies to any pre-release or beta version of our apps — including CalorieNoted and GymNoted — that we make available to you ("Beta Software"). By accepting this Agreement or using the Beta Software, you agree to these terms. It sits alongside our Terms of Service and Privacy Policy; where this Agreement conflicts with the Terms of Service for beta use, this Agreement applies.
1. Eligibility
You must be at least 18 years old to take part. Beta access is personal to you, offered at our discretion, and may be limited, paused or withdrawn at any time. You agree not to share beta builds, invite links or TestFlight codes with anyone else.
2. Pre-release software
Beta Software is provided for testing and evaluation only. It is a work in progress and may be incomplete, contain bugs, behave unexpectedly, or change or be discontinued at any time. It is not intended for production use and should not be relied on. Features in a beta may never reach the public release.
3. Health & nutrition disclaimer
Our apps help you track information such as nutrition and activity. They are not medical devices and are not a substitute for professional medical, dietary or health advice. Any figures, targets or suggestions — including calorie, kilojoule and macro data, and any guidance from automated or AI features — are general estimates only, are generated automatically, and during beta may be especially inaccurate or unreliable. AI-generated responses can be wrong and are not reviewed by a health professional. Always use your own judgement and speak to a qualified professional before making health decisions, particularly if you are pregnant, under 18, or have a medical condition or history of disordered eating.
4. Feedback
We'd love your feedback — bug reports, suggestions and ideas. You grant us a perpetual, worldwide, royalty-free, irrevocable licence to use, copy and incorporate any feedback you give us into our products and services, without obligation or compensation to you. You confirm your feedback is your own to give and doesn't infringe anyone else's rights.
5. Confidentiality
Beta Software and anything you learn through the beta that isn't public (including unreleased features, screenshots and performance) is confidential. Please don't publicly post, stream, benchmark or share details of the Beta Software without our written permission, until that feature is publicly released.
6. Data & privacy
We handle your information in line with our Privacy Policy. During a beta we may collect additional diagnostic, crash and usage information — including through Apple's TestFlight — to help us find and fix problems. Beta data may be reset or deleted between builds, so please don't treat the Beta Software as your only record of anything important.
7. No warranty
The Beta Software is provided "as is" and "as available", without warranties of any kind to the extent permitted by law. Nothing in this Agreement excludes rights you have under the Australian Consumer Law that cannot lawfully be excluded.
8. Liability
To the extent permitted by law, we are not liable for any loss or damage arising from your use of the Beta Software, including lost data or inaccurate tracking information. Where our liability cannot be excluded, it is limited to re-supplying the software or the cost of doing so.
9. Term & termination
This Agreement starts when you accept it and continues until the beta ends or either of us ends your participation. You can leave the beta at any time by removing the Beta Software. On termination you must stop using the Beta Software, and the confidentiality and feedback terms continue to apply.
