These Terms of Service ("Terms") are an agreement between you and Noted Labs (ABN 98 693 357 425) covering your use of our website, apps and services, including CalorieNoted and GymNoted (together, the "Services"). By using the Services, you agree to these Terms. If you don't agree, please don't use the Services.
The Services
Our apps help you track and understand your nutrition and training. Depending on the app and your plan, features may include: food, calorie and kilojoule logging with a searchable food database and barcode scanning; automatically generated calorie, kilojoule and macro goals and suggestions; AI-assisted logging that can interpret meal photos, voice input and food-label images to help you log faster; and workout planning, progress logging and performance insights.
Some features rely on third-party providers (for example, AI processing) and on the accuracy of the information you enter. Any goals, suggestions or other outputs the apps generate are general information only — see the Health disclaimer below. We may add, change or remove features as the Services develop.
Using the Services
- You must be at least 18 years old to use the Services.
- You agree to use the Services lawfully and not to misuse, disrupt or attempt to gain unauthorised access to them.
- You're responsible for the accuracy of the information you enter and for keeping your device and account secure.
Health disclaimer
Our apps are tools to help you track and understand your nutrition and activity. They are not medical devices and are not a substitute for professional medical, dietary or fitness advice.
Any figures, targets or suggestions the app provides — including calorie and kilojoule goals, macro targets, and any guidance produced by automated or AI features — are general information and estimates only. They are generated automatically from the data you enter and standard formulas, are not personalised professional advice, and may be inaccurate or unsuitable for you. AI-generated responses in particular can be incomplete or wrong and are not reviewed by a health professional.
Always consult a qualified health professional before acting on any suggestion or making decisions about your diet, training or health — especially if you are pregnant, under 18, or have a medical condition or a history of disordered eating. You use the Services, and rely on any information they provide, at your own discretion and risk.
Your content
The data and content you enter remain yours. You grant us the permission needed to operate, provide and improve the Services for you — for example, to store, process and sync your data so the app works as intended.
You also grant us permission to analyse your data to run and improve the Services — including to generate your goals, suggestions and insights, to troubleshoot problems, to understand how the Services are used, and to develop and improve features (including automated and AI features). Where our team or systems need to review user data for these purposes, we do so on a de-identified basis wherever practicable — that is, with your identity hidden. We may also create and use aggregated or de-identified data, which no longer identifies you, without restriction.
We handle your personal information in accordance with our Privacy Policy.
Beta features
Beta and pre-release features are provided "as is" and may be incomplete, change, or be removed at any time. They may be less stable than released features. Your participation in the beta program is also subject to these Terms and Apple's TestFlight terms. Learn more on our Beta page.
Purchases and subscriptions
Any paid features, purchases or subscriptions are processed through the Apple App Store and are subject to Apple's terms. Billing, renewals, refunds and cancellations are handled according to those terms and your App Store account settings.
Intellectual property
The Services — including their design, software, branding, and the content we create (other than your own data) — are owned by Noted Labs and protected by law. Our own food database, including its structure, selection, arrangement and the entries we create or curate, is owned by Noted Labs as a compilation.
The apps also let you search third-party and publicly available food databases — including Open Food Facts and government food-composition databases (USDA FoodData Central and the FSANZ Australian Food Composition Database) — and add items to your own log. That data remains the property of its respective owners and is used under the applicable licences; we don't claim ownership of it. The sources and their licences are listed on our Acknowledgements page.
You may not copy, modify or distribute the Services except as permitted by these Terms or by the licences that apply to the underlying third-party data.
Availability and changes
We may update, change or discontinue parts of the Services at any time. We may also update these Terms; when we do, we'll revise the "last updated" date above, and continued use of the Services means you accept the updated Terms.
Liability
To the extent permitted by law, the Services are provided "as is" without warranties of any kind, and Noted Labs is not liable for indirect or consequential loss arising from your use of the Services. Nothing in these Terms excludes rights you have under the Australian Consumer Law that cannot lawfully be excluded.
Governing law
These Terms are governed by the laws of Victoria, Australia, and you submit to the courts of that jurisdiction.
